These Terms of Service ("Terms") are an agreement between you and Diabetic Saver LLC, a Nevada limited liability company doing business as Diabetic Saver ("Diabetic Saver," "we," "us"). They apply to your use of diabeticsaver.com (the "Site") and to every purchase you make from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms incorporate our Shipping & Returns policy, Privacy Policy, and Medical Disclaimer.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site or place an order. We sell and ship only to addresses in the United States, including Puerto Rico and military/APO addresses.

2. Independent reseller

Diabetic Saver is an independent reseller of diabetes supplies. We are not affiliated with, endorsed by, or sponsored by the manufacturers of the products we sell. Product names, brands and trademarks belong to their owners and are used on the Site only to identify the products.

3. Not medical advice

Information on the Site is for general information only and is not medical advice. Using the Site does not create a healthcare provider–patient relationship with us. Talk with your healthcare provider about which products are right for you, and always follow the manufacturer's instructions for use. If you have a medical emergency, call 911. You are responsible for confirming that a product is compatible with your devices, meter, pump, phone or app before you buy.

4. Your account

You may check out as a guest or create an account. If you create an account, keep your login details secure and tell us right away if you think someone else has used it. You are responsible for activity on your account. We may suspend or close accounts that violate these Terms.

5. Product information and pricing

We try to describe and photograph products accurately and to keep prices and availability current. Packaging, lot numbers, expiration dates and appearance may differ from the images shown. Errors can happen. If a product's price or description is wrong, we may correct it, and we may cancel any order placed at the incorrect price or description, even after we have sent an order confirmation. If we cancel an order you have already paid for, we will refund you in full.

Prices are in U.S. dollars. Prices, promotions and availability may change without notice, but the price you pay is the price shown when you place your order. Applicable sales tax is calculated at checkout.

6. Orders and payment

Your order is an offer to buy. We accept it when we ship it. We may decline or cancel any order, including for suspected fraud, unauthorized or resale activity, an address we cannot ship to, or product unavailability. We may contact you by phone or email to verify large orders before they ship. If we cannot verify an order, we may cancel it. If we cancel after charging you, we will refund you in full.

We accept the payment methods shown at checkout, which currently include major credit cards, Shop Pay, PayPal, Apple Pay and Google Pay. By placing an order, you confirm that you are authorized to use the payment method and that the information you give us is accurate.

Products are sold for your personal use or the use of a member of your household, and not for resale.

7. Shipping, returns and refunds

Shipping methods, processing times, delivery estimates, return deadlines and refund timing are described in our Shipping & Returns policy, which is part of these Terms. In summary: standard shipping is free within the contiguous United States; orders placed by 3:00 PM Pacific Time on a business day ship the same day; damaged, defective or incorrect items must be reported within 5 days of receiving your order; and approved returns must be new, unopened and sent back within 30 days of purchase. For safety and regulatory reasons, we cannot accept opened CGM sensors, opened insulin pump pods or other opened medical devices.

Delivery dates are estimates. Title and risk of loss pass to you when we deliver your order to the carrier. If your package is lost in transit, contact us and we will work with the carrier and replace your order at no cost to you.

8. Subscriptions

If you sign up for a subscription, you authorize us to charge your payment method automatically for each recurring order, at the frequency and price you selected at checkout, plus any applicable tax, until you cancel.

• Price and discount: Your subscription price, including any subscription discount, is shown at checkout and in your account. We may change the subscription price. If we do, we will email you at least 7 days before the new price applies, and you can cancel before then.
• Reminders: We email you a reminder before each recurring order is charged and shipped.
• Manage or cancel: You can skip, pause, change or cancel your subscription at any time by logging into your account, by emailing Support@DiabeticSaver.com, or by calling (702) 983-6999. Cancellation stops future orders. To stop your next order, cancel before the next order date shown in your account.
• Orders already charged and shipped follow our Shipping & Returns policy.

9. Product warranties

We do not make any warranty of our own about the products we sell. Any warranty from the manufacturer is provided by the manufacturer, not by us, and whether it applies is determined by the manufacturer.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some states do not allow these disclaimers, so they may not apply to you.

10. Reviews and content you submit

If you post a review, question or other content, you confirm that it is truthful, reflects your own experience, and does not include anyone else's personal or health information. You give us a non-exclusive, royalty-free, worldwide license to display, reproduce and share that content on the Site and in our marketing, with the display name you choose. We may decline to post or remove content that is unlawful, abusive, off-topic or contains personal or medical information, but we do not remove reviews just because they are negative.

We do not offer discounts, payments or other incentives in exchange for reviews.

11. Acceptable use

You agree not to: use the Site for any unlawful purpose; place fraudulent orders or orders for resale; interfere with the Site's operation or security; use bots, scrapers or other automated tools to access the Site or collect data (other than standard search engine indexing); upload malware; or impersonate anyone. We may suspend or end your access to the Site if you violate these Terms.

12. Intellectual property

The Site and its content, including text, graphics, logos, photos and design, belong to Diabetic Saver or its licensors and are protected by law. You may use the Site for your own personal shopping. You may not copy, modify or reuse its content for commercial purposes without our written permission. Manufacturer trademarks belong to their owners (see Section 2).

13. Third-party sites and services

The Site may link to or use third-party websites and services, such as payment processors and shipping carriers. We are not responsible for their content or practices, and their own terms and privacy policies apply.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (a) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT; AND (b) OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT THAT IS THE SUBJECT OF THE CLAIM.

These limits do not apply to liability for death or personal injury caused by our negligence, for our fraud, gross negligence or willful misconduct, or to any liability that cannot be limited under applicable law. Some states do not allow these limits, so they may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Diabetic Saver and its owners, employees and agents from third-party claims arising from your violation of these Terms, your misuse of the Site, or content you submit, to the extent permitted by law.

16. Disputes and governing law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules, except where the consumer protection laws of your state of residence give you rights that cannot be waived.

Before filing a claim, please contact us at Support@DiabeticSaver.com so we can try to resolve it informally. Most concerns can be resolved quickly this way.

Any claim that is not resolved informally must be brought in the state or federal courts located in Clark County, Nevada, and you and we consent to their jurisdiction. Either party may bring a qualifying claim in small claims court in the county where you live.

17. Changes to these Terms

We may update these Terms by posting a new version with a new effective date. Changes apply to orders placed and use of the Site after the change is posted. The Terms in effect when you placed an order apply to that order. If a material change affects your subscription, we will email you before it takes effect.

18. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, sale or reorganization. These Terms, together with the policies listed at the top, are the entire agreement between you and us about the Site and your purchases. We are not responsible for delays or failures caused by events beyond our reasonable control. You agree that we may send you notices, order confirmations and other communications electronically.
